TERMS OF SERVICE


These terms apply when you use beyondmx.co.uk or purchase goods from Beyond MX. Nothing in these terms limits rights that cannot lawfully be limited, including your statutory consumer rights.


1. ABOUT US AND CONTACTING US


Beyond MX is based at 75 Woodburn Road, Unit 6, Carrickfergus, BT38 8PS, United Kingdom.


Customer service is provided by email at info@beyondmx.co.uk. We aim to respond within one working day.


2. ORDERS


An order is an offer to buy the products in your basket. A contract is formed when we accept the order and send confirmation.


Orders remain subject to stock availability, payment authorisation and fraud checks. If we cannot accept an order, we will notify you and refund any payment taken.


3. PRICES AND PAYMENT


Prices are displayed in the selected currency and include UK taxes where the product page or checkout states that taxes are included.


Delivery charges and any applicable destination charges are shown separately. You will be charged the price accepted at checkout.


Payment is processed securely using the payment methods displayed at checkout.


4. PRODUCT INFORMATION AND COMPATIBILITY


We take reasonable care to keep product descriptions, photographs and compatibility information accurate. Product images are illustrative and minor variations may occur.


Motocross parts are specialist components. Before installation, you are responsible for checking the motorcycle model, model year, engine specification and intended application against the product description.


If you are unsure about compatibility, email us before fitting the part.


5. INSTALLATION AND USE


Products must be installed, adjusted, maintained and used correctly. Where appropriate, installation should be carried out by a competent mechanic.


Motocross and off-road riding involve inherent risks. We are not responsible for damage resulting from incorrect installation, incompatible fitment, misuse, racing accidents, unauthorised modification or failure to follow maintenance instructions.


Nothing in these terms excludes liability where it would be unlawful to do so.


6. DELIVERY


Delivery options, charges and estimated times are set out in our Shipping Policy and at checkout.


We will deliver within the agreed period or, where no period is agreed, within the period required by applicable law.


Risk in the goods passes when they are delivered to you or to a person identified by you to receive them, subject to applicable law.


7. CANCELLATIONS, RETURNS AND REFUNDS


Our Returns and Refunds Policy explains cancellation rights, return conditions and how oil-contaminated, installed, used or altered components are treated.


Installing or oiling a clutch component may reduce its value to zero because it cannot be resold as a new product.


This does not affect statutory rights where goods are faulty, damaged when delivered, incorrectly supplied or not as described.


8. FAULTY GOODS AND WARRANTIES


Goods must be as described, of satisfactory quality and fit for any purpose made known where applicable law requires.


Manufacturer warranties are additional to your statutory rights and do not replace Beyond MX’s responsibilities as the retailer.


Remedies for faulty goods will be provided in accordance with applicable law.


9. CUSTOM AND SPECIAL-ORDER PRODUCTS


Genuinely personalised or custom-made goods produced to your specification may be excluded from change-of-mind cancellation rights.


Any applicable restriction will be made clear before purchase. This does not affect your rights if the goods are faulty or not as described.


10. INTELLECTUAL PROPERTY


The website, Beyond MX branding and original site content are owned by Beyond MX or used with permission.


Manufacturer product text, trademarks and images remain the property of their respective owners.


You may use the site for personal shopping purposes but may not reproduce or commercially exploit its content without permission.


11. LIABILITY


We do not exclude or limit liability for death or personal injury caused by negligence, fraud, breach of statutory consumer rights or any other liability that cannot lawfully be excluded.


Subject to this, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.


We are not responsible for third-party websites or services that we do not control.


12. ACCOUNTS AND ACCEPTABLE USE


If you create a customer account, you are responsible for providing accurate information and keeping your login details secure.


You must not misuse the website, introduce malicious software, attempt unauthorised access, interfere with the website’s operation or use its content unlawfully.


We may restrict access where reasonably necessary to protect the website, customers or the business.


13. PRIVACY


Personal information is handled in accordance with our Privacy Policy.


14. GOVERNING LAW


These terms are governed by the laws applicable in Northern Ireland.


If you are a consumer living elsewhere, you retain any mandatory protections provided by the law of your country or region.


Disputes may be brought before any court that has jurisdiction under applicable consumer law.


15. CHANGES TO THESE TERMS


We may update these terms for future orders. The terms applying to an order are those in force when that order is placed.


16. SEVERABILITY


If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
